What is the Class Action about?

The lawsuit claims that the Defendant marketed and sold the Truffettes de France
products in Canada in a misleading way – specifically, by indicating they were
made in France when they were allegedly manufactured in Canada. The Plaintiffs
claim that this caused economic loss to Class Members. Accordingly, the lawsuit
seeks monetary compensation from the Defendant and seeks both monetary
compensation and an injunction against continued misrepresentation.

“Truffettes de France Products” means any Truffettes de France products bearing
the phrase “Truffettes de France” on their label, including:

1.  Original Cocoa Truffles,
 2.  Milk Chocolate Truffles,
 3.  Milk & Hazelnut Truffles,
 4.  Milk & Almond Truffles,
 5.  Salted Caramel Cocoa Truffles,
 6.  Coffee Crunch Truffles,
 7.  Cognac Champagne Truffles,
 8.  Organic Original Truffles,
 9.  Organic Caramel Cocoa Truffles,
 10. Raspberry Flavoured Cocoa Truffles,
 11. French Mallows;
 12. 70% Cacao Truffles;
 13. “Pépites” Truffles;
 14. Double Coated Truffles;

The Defendant denies all allegations of wrongdoing. The Court has made no
determination about the merits of the case.

Why is there a Settlement?

Accepted Answer

The Court did not decide in favour of the Plaintiffs or the Defendant. Instead,
both sides agreed to settle this case to end this lawsuit and avoid the costs,
delay, and uncertainly of a trial and subsequent appeals. The proposed
Settlement does not mean that any law was broken or that the Defendant did
anything wrong. The Defendant denies all claims in this case. The Plaintiffs and
Class Counsel believe that the Settlement is best interest of all Class Members.
The Settlement will not take effect unless and until it is approved by the Court
after a public Settlement Approval Hearing and all appeal periods have expired.

one Truffettes de France Product from April 7, 2022 to September 5, 2026.

You are not included if you: (i) are an officer, director, employee, contractor,
